Khoros has consulted outside IP counsel in the EU regarding the pending EU Copyright Directive and has concluded that: (i) Member States will have 24 months to implement the Directive into local law before it becomes enforceable, and the clock has not yet begun ticking; (ii) the Directive was created to protect online content sharing service providers and targets only online content service providers who play an important role in the online content market by competing with other online content sharing service providers; and (iii) Khoros does not fall under this definition and Khoros’s customers most likely do not either. Khoros will continue to monitor the Directive as Member States begin implementing it into their local laws.
